PROPOSED REGULATION

Article 28a– Physician Assistants

K.A.R. 100-28a-10. Supervision and direction; adequacy. (a) Direction and supervision of the physician assistant shall be considered to be adequate if the responsible physician meets all of the following requirements:
(a) (1) At least annually, reviews and evaluates the professional competency of the physician assistant;
(b) (2) at least annually, reviews any drug prescription protocol and determines if any modifications, restrictions, or terminations are required. Any Each of these changes shall be conveyed to the physician assistant and set forth in all copies of the protocol required by K.A.R. 100-28a-9 to be maintained and provided;
(c) (3) engages in the practice of medicine and surgery in this state;
(d) (4) insures ensures that the physician assistant has a current license issued by the board;
(e) (5) within 10 days, reports to the board any knowledge of disciplinary hearings, formal hearings, public or private censure, or other disciplinary action taken against the physician assistant by any state’s licensure or registration authority or any professional association;
(f) (6) within 10 days, reports to the board any litigation, threatened litigation, or claim alleging professional incompetency or professional negligence on the part of the physician assistant;
(g) (7) at least every 14 days, reviews all records of patients treated by the physician assistant and authenticates this review in the patient record determines whether or not the physician assistant has performed patient services constituting the practice of medicine and surgery with reasonable skill and safety, including whether or not any drug prescribed by the physician assistant was clinically indicated and whether or not the prescription order was appropriate;
(h) (8) reviews patient records and authenticates the review in each patient record within 48 hours of treatment provided by the physician assistant if the treatment provided in an emergency exceeded the authority granted to the physician assistant by the responsible physician request form required by K.A.R. 100-28a-9;
(i) (9) provides for a designated physician to provide supervision and direction on each occasion when the responsible physician is temporarily absent, is unable to be immediately contacted by telecommunication, or is otherwise unavailable at a time the physician assistant could reasonably be expected to provide professional services; and
(j) (10) delegates to the physician assistant only those acts that constitute the practice of medicine and surgery that the responsible physician believes or has reason to believe can be competently performed by the physician assistant, based upon the physician assistant’s background, training, capabilities, skill, and experience.
(b) For each patient treated by the physician assistant, the responsible physician shall make the determination required by paragraph (a)(7) either by consulting with the physician assistant when the physician assistant treats the patient and documenting the consultation in the patient record or by engaging in one or more of the following activities within 14 days after the physician assistant treats the patient:
(1) Discussing routine cases of patient care pertinent to that patient in a grand rounds conference with the physician assistant. The responsible physician shall either document in each patient record the date of the discussion or create and maintain for at least five years a separate written record that includes the date and the issues discussed at each grand rounds conference;
(2) consulting with the physician assistant and ascertaining that the patient care was consistent with written protocols approved by the responsible physician for treatment in specific types of cases; or
(3) reviewing the patient record and documenting the review in the patient record.
