Article 22– Dishonorable Conduct
K.A.R. 100-22-8. Phosphatidylcholine and sodium
deoxycholate.*(a) Except as specified in subsection (b),
a person licensed to practice medicine and surgery or osteopathic
medicine and surgery shall not administer or authorize the administration
of phosphatidylcholine or sodium deoxycholate, or any combination
of these substances, by subcutaneous injection for the purpose of
eliminating or reducing localized fat accumulation.
(b) This regulation
shall not apply to clinical research on the administration of phosphatidylcholine
or sodium deoxycholate, or any combination of these substances,
as an investigational new drug.
(c) Each departure
from this regulation shall constitute prima facie evidence of dishonorable

*The Honorable David E. Bruns issued an order temporarily
allowing a licensed M.D. or D.O. who properly performs a physical
examination of the patient and records the patient’s medical
history to issue a written prescription order to compound the mixture
in accordance with the appropriate standard of care. The Board will
conduct further hearings on this regulation, and notice of those
hearings will be published in the Kansas Register.
