INFORMATION AND EDUCATION PROGRAM GOAL:
To increase transparency and promote greater awareness of the role, programs, and regulatory actions of the State Board of Healing Arts and to accurately and promptly provide information to all of the agency’s staff and customers, including the members of the Board itself, councils of the Board, the Legislature, public, the media, other states, government agencies, private entities, applicants, licensees and national data banks.
OBJECTIVE #1:
To meet all applicable statutory time limits in providing information to those requesting it, including reports to national data banks, electronic data requests, and requests made under the Kansas Open Records Act and to disseminate accurate information, some of which is protected from disclosure or is confidential under the Healing Arts Act, peer review, risk management and other applicable statutes, to those desiring information.
Strategies for Objective #1:
- Respond to requests made under the Kansas Open Records Act in accordance with K.S.A. 45-218.
- Make reports to national data banks in accordance with Federal law and agreements the Board has with various national data banks.
- Encourage use of e-mail for requesting agency records.
- Provide information and data to appropriate requesters in the electronic format requested.
Performance Measures for Objective #1:
OUTCOME MEASURES:
- Utilize the IT Enhancements to use the same number of FTE’s to respond to an increasing number of open record requests (see Schedule of Open Records Requests) within the time limits specified by K.S.A. 45-218.
- Utilize the same number of FTE’s to report an increased number of adverse actions to National Practitioner Data Bank and other national data banks. (See Schedule of Adverse Actions Reported) within 30 days of final action.
- Track requests and responses made by e-mail.
- Utilize the same number of FTE’s to provide information and data in response to professional data requests (see Schedule of Professional Data Requests) within time specified by K.S.A. 45-218.
OUTPUT MEASURES:
- Response to 100% of all requests under the Kansas Open Record Act are made in accordance with K.S.A. 45-218.
- 100% of all adverse actions are reported within 30 days of the date of final action.
- 100% of all data requests are provided within the time specified by K.S.A. 45-218.

OBJECTIVE #2:
To increase the amount of information that is available to the public and the Board’s customers over the Internet and increase public awareness of the Board’s actions and services through other appropriate media sources.
Strategies for Objective #2:
- Redesign agency website as mandated by HB #2620, New Section 4.
- Provide additional information on Board licensees to public and other Board customers through electronic communications and reduce the number of telephone calls and written requests made to the Board office.
- Make information previously provided through hardcopy mailings and phone contact available on the Board’s website.
- Publish public service announcements through television and radio to inform the public about the agency.
- Publish a bi-annual newsletter to licensees to be posted to website and primarily distributed via email.
- Hire a Public Information Officer as requested in FY2009 Supplement and FY2010/2011 Enhancement.
Performance Measures for Objective #2:
OUTCOME MEASURES:
- Existence of public derogatory information will continue to be able to be accessed from the Board database presently provided to INK/Kansas.gov with instructions directing persons to Board website for review of actual Board order.
- Access to additional, searchable database information will be available on the Board website.
- Telephone and written requests to Board office for information will be reduced.
- Information previously provided through hardcopy mailings will be placed on the Board’s website, reducing printing and mailing costs and staff response time.
- Increased compliance with Board Policy 95-01, Policy Press Release Regarding Disciplinary Actions.
- Increased agency transparency.
OUTPUT MEASURES:
- Access to disciplinary information will continue to be available via the database.
- Access to additional, searchable database information for all healing arts professions will be available on the Board website by FY2010.
- Placement of FAQ’s (frequently asked questions) placed on the Board website not later than October 1, 2008.
- Increased number of electronic requests and decreased number of hard copy requests for agency records.
- Press releases issued for 100% of all of the following disciplinary actions taken by the Board: emergency action taken which suspends or limits a license or registration, revocation or surrender of a license or registration in lieu of formal proceedings, and when disciplinary action taken would be important to health care decisions of citizens.
OBJECTIVE #3:
To promptly certify individuals who are eligible as shareholders in professional corporations or participants in professional limited liability companies and approve names of such entities.
Strategies for Objective #3:
Propose a statutory amendment to allow the Board to charge a reasonable fee for certifying individuals who are eligible as shareholders and approval of corporate names. Within three (3) months of promulgation of the amended statute, draft regulations to set forth the application process and the requisite fee.
OUTCOME MEASURES:
- Utilize the same number of FTE positions to issue an increasing number of certifications and approvals.
- Work with the office of the Secretary of State to electronically transmit certificates and approvals.
OUTPUT MEASURES:
- See Schedule of Corporation and LLC Certification Requests below.
- Certificates and approvals are electronically transmitted to the Secretary of State.

To increase efficiency and improve the response time in carrying out directives of the Board.
Strategies for Objective #4:
- Reorganize/redistribute duties of existing FTE Administrative positions in order to provide timely response to all requests, actions and directives of the Board, following all regularly scheduled and special Board meetings.
- Hire a Deputy Director as requested in FY2009 Supplement and FY2010/2011 Enhancement.

- All Board requests, actions and directives will be responded to within requested timeframes with no carryover to subsequent board meetings.
